Zaključak koji je prije desetak dana donesen na sastanku Vrhovnog suda RH s predsjednicima vijeća Visokog kaznenog suda Republike Hrvatske i predsjednicima kaznenih odjela županijskih sudova mogao bi dovesti do toga da VKS ukine nepravomoćnu presudu Filipu Zavadlavu, osuđenom na 40 godina zatvora zbog trostrukog ubojstva u siječnju 2020. godine u centru Splita!
Zaključkom je, naime, izričito određeno da se odsad dopisivanje između zatvorenika i odvjetnika ne smije kontrolirati.

---Ako i dođe do ponovnog suđenja Zavadlavu, neće mu se suditi u Splitu, već na VKS-u u Zagrebu s obzirom na to da bi to bilo drugo ukidanje presude. Iako neki iskusni suci "kaznenjaci" smatraju da je vrlo mala vjerojatnost za presuda Zavadlavu bude ukinuta zbog povrede prava na pravično suđenje koja se, ako je do nje uopće došlo, mora gledati u širem kontekstu cijelog postupka, a ne samo na izdvojenu situaciju, s obzirom na neke recentne odluke VKS-a u kojima su se presude ukidale zbog minornijih proceduralnih propusta, nije nemoguće očekivati da će i ova Zavadlavova biti ukinuta.

Dakle, ovaj se zaključak odnosi na odredbu ZKP-a koja propisuje da se "zatvorenik smije dopisivati s osobama izvan zatvora sa znanjem i pod nadzorom suca istrage, a nakon podignute optužnice, sa znanjem i pod nadzorom predsjednika vijeća" te da se "zatvoreniku može zabraniti odašiljanje i primanje pisama i drugih pošiljaka, ali ne i odašiljanje molbe, pritužbe ili žalbe". Suci su zaključili da se ta odredba "o nadzoru dopisivanja ne odnosi na dopisivanje istražnog zatvorenika i branitelja".
Zašto je to važno za slučaj Zavadlav? Zato što je njegova tadašnja odvjetnica Doris Košta još u studenom prošle godine predložila pokretanje stegovnog postupka protiv Višnje Strinić, sutkinje Županijskog suda u Splitu, koja je u dva navrata osudila Zavadlava zato što je ona pročitala i otvorila jedno njegovo pismo koje je iz zatvora u Gospiću uputio odvjetnici Košta. Odvjetnica je smatrala da je time povrijeđeno njegovo pravo kao okrivljenika, a pozivala se na čl. 64. st. 1. toč. 5. ZKP-a koji navodi kako okrivljenik ima pravo "slobodno, nesmetano i povjerljivo komunicirati s braniteljem".

Predsjednik Županijskog suda u Splitu odbio je tada pokrenuti stegovni postupak smatrajući da je sutkinja radila svoj posao po zakonu, a takav njegov stav potvrdili su i u Ministarstvu pravosuđa.
Početkom ove godine i sam Zavadlav je na adresu ŽDO-a Split, tadašnje glavne državne odvjetnice Zlate Hrvoje Šipek te predsjednika Vrhovnog suda Radovana Dobronića kazneno prijavio sutkinju zbog "sumnje u produljeno djelo zlouporabe položaja i ovlasti". Uz ostalo je naveo i da je, osim njegova pisma iz svibnja 2023. godine upućenog Košti, otvorila i dva pisma upućena odvjetnici Gordani Peraković-Turković te odvjetniku Josipu Giljanoviću. Nije nam poznato je li se po toj prijavi i postupalo.

- Od početka sam znala da sam u pravu. Nedopustivo je da ministar pravosuđa, predsjednik Županijskog suda i suci ne postupaju u skladu sa zakonom, a dužni su osigurati pošten postupak. Naravno da neću stati samo na utvrđenju da su povrijedili zakon. Ovo je sigurno osnova za ukidanje presude jer sudac ne zadovoljava ni subjektivni ni objektivni kriterij nepristranosti, čime čini povredu prava na pošteno i pravično suđenje - kazala nam je odvjetnica Košta.
Treba vidjeti hoće li njezin stav, nakon ovoga, dijeliti i vijeće Visokog kaznenog suda.

---Ako i dođe do ponovnog suđenja Zavadlavu, neće mu se suditi u Splitu, već na VKS-u u Zagrebu s obzirom na to da bi to bilo drugo ukidanje presude. Iako neki iskusni suci "kaznenjaci" smatraju da je vrlo mala vjerojatnost za presuda Zavadlavu bude ukinuta zbog povrede prava na pravično suđenje koja se, ako je do nje uopće došlo, mora gledati u širem kontekstu cijelog postupka, a ne samo na izdvojenu situaciju, s obzirom na neke recentne odluke VKS-a u kojima su se presude ukidale zbog minornijih proceduralnih propusta, nije nemoguće očekivati da će i ova Zavadlavova biti ukinuta.

Dakle, ovaj se zaključak odnosi na odredbu ZKP-a koja propisuje da se "zatvorenik smije dopisivati s osobama izvan zatvora sa znanjem i pod nadzorom suca istrage, a nakon podignute optužnice, sa znanjem i pod nadzorom predsjednika vijeća" te da se "zatvoreniku može zabraniti odašiljanje i primanje pisama i drugih pošiljaka, ali ne i odašiljanje molbe, pritužbe ili žalbe". Suci su zaključili da se ta odredba "o nadzoru dopisivanja ne odnosi na dopisivanje istražnog zatvorenika i branitelja".
Zašto je to važno za slučaj Zavadlav? Zato što je njegova tadašnja odvjetnica Doris Košta još u studenom prošle godine predložila pokretanje stegovnog postupka protiv Višnje Strinić, sutkinje Županijskog suda u Splitu, koja je u dva navrata osudila Zavadlava zato što je ona pročitala i otvorila jedno njegovo pismo koje je iz zatvora u Gospiću uputio odvjetnici Košta. Odvjetnica je smatrala da je time povrijeđeno njegovo pravo kao okrivljenika, a pozivala se na čl. 64. st. 1. toč. 5. ZKP-a koji navodi kako okrivljenik ima pravo "slobodno, nesmetano i povjerljivo komunicirati s braniteljem".

Predsjednik Županijskog suda u Splitu odbio je tada pokrenuti stegovni postupak smatrajući da je sutkinja radila svoj posao po zakonu, a takav njegov stav potvrdili su i u Ministarstvu pravosuđa.
Početkom ove godine i sam Zavadlav je na adresu ŽDO-a Split, tadašnje glavne državne odvjetnice Zlate Hrvoje Šipek te predsjednika Vrhovnog suda Radovana Dobronića kazneno prijavio sutkinju zbog "sumnje u produljeno djelo zlouporabe položaja i ovlasti". Uz ostalo je naveo i da je, osim njegova pisma iz svibnja 2023. godine upućenog Košti, otvorila i dva pisma upućena odvjetnici Gordani Peraković-Turković te odvjetniku Josipu Giljanoviću. Nije nam poznato je li se po toj prijavi i postupalo.

- Od početka sam znala da sam u pravu. Nedopustivo je da ministar pravosuđa, predsjednik Županijskog suda i suci ne postupaju u skladu sa zakonom, a dužni su osigurati pošten postupak. Naravno da neću stati samo na utvrđenju da su povrijedili zakon. Ovo je sigurno osnova za ukidanje presude jer sudac ne zadovoljava ni subjektivni ni objektivni kriterij nepristranosti, čime čini povredu prava na pošteno i pravično suđenje - kazala nam je odvjetnica Košta.
Treba vidjeti hoće li njezin stav, nakon ovoga, dijeliti i vijeće Visokog kaznenog suda.
